Participant Waiver
Every pilot must agree to and sign this waiver before flying. It's part of the booking form, so if you booked online, you've already signed it. If you need to sign separately, use the form below the waiver. If the pilot is under 18, a parent or legal guardian completes and signs it for them.
Participant Waiver and Release of Liability
Please read carefully. This waiver affects your legal rights. Every pilot must agree to it before their flight. If the pilot is under 18, a parent or legal guardian must complete and sign it for them.
The activity. Monterey FPV Experience ("Monterey FPV," "we," "us") offers hands-on drone flight sessions. Participants pilot a DJI Avata 2 FPV drone while wearing FPV goggles, guided by an instructor, at outdoor locations in the Monterey area that we choose based on the weather and conditions.
Assumption of risk. I understand that flying a drone and wearing FPV goggles involve risks, including but not limited to: motion sickness, dizziness, disorientation, eye strain or headaches from the goggles; trips, slips and falls on uneven outdoor ground; contact with a moving drone or its propellers; exposure to sun, wind, cold and other weather; and injury to myself or others or damage to property. I choose to participate voluntarily and accept these risks, both known and unknown.
Health. I confirm I have no medical condition that would make participating unsafe for me, and that I am not under the influence of alcohol or drugs. If I have a history of seizures (including photosensitive epilepsy), severe motion sickness, a heart condition, or am pregnant, I will tell my instructor before flying. I will remove the goggles and stop flying if I feel unwell.
Following instructions. I agree to follow the safety briefing and all instructions from my instructor, including instructions to land, hand over the controls, or end the session. The instructor may pause or end a session at any time for safety, weather, airspace or wildlife reasons. I will not fly over people, vehicles, animals, or any area the instructor marks as off-limits.
Equipment. All drones, goggles and controllers remain the property of Monterey FPV. I will handle the equipment with care and use it only as instructed.
Release of liability. To the fullest extent permitted by law, I release, waive and agree not to sue Monterey FPV Experience and its owners, instructors, employees and agents (the "Released Parties") for any claims, losses or liability for injury, illness, death or property damage arising from or related to my participation, including claims caused by the ordinary negligence of the Released Parties. This release does not apply to gross negligence or willful misconduct.
Indemnity. I agree to indemnify and hold harmless the Released Parties from any claims brought by others that arise from my own conduct or my failure to follow instructions during the session.
Medical treatment. In an emergency, I authorize Monterey FPV to seek emergency medical treatment for me (or for the minor I am signing for), and I agree to be responsible for any related costs.
Minors. If I am signing for a participant under 18, I confirm I am their parent or legal guardian, I agree to all of these terms on their behalf, and I accept responsibility for their participation.
General. This waiver is governed by the laws of the State of California. If any part of it is found unenforceable, the rest remains in effect. I have read this waiver, I understand it, and I am agreeing to it voluntarily.
